Argumentative
Question argues with or challenges the witness rather than seeking testimony.
Asked and Answered
Same question has been asked and answered. Wastes time and harasses witness.
Assumes Facts Not in Evidence
Question presumes a fact that hasn't been established. Rephrase without the presumption.
Calls for Narrative
Question is too broad and invites witness to ramble. Ask specific questions instead.
Calls for Speculation
Witness is asked to guess or speculate about facts they don't know. Only experts can speculate (with foundation).
Mischaracterizes Testimony/Evidence
Question misstates what the witness said or what document says. Correct the record.
Beyond the Scope
On cross-exam, question goes beyond scope of direct examination. Limited to areas covered on direct.

Best Evidence Rule (TRE 1002)
Original document must be produced if its contents are material. Copy acceptable with proper foundation.
Parol Evidence
Oral testimony cannot be used to contradict, modify, or supplement an integrated written agreement.
Dead Man's Rule (TRE 601)
In suit involving estate, living party cannot testify about communications with deceased unless heirs consent or exception applies.

DO NOT: "Objection, the answer would be hearsay because the defendant is going to testify that..."

DO: "Objection, hearsay. The witness may answer." — Then let opposing counsel decide whether to press or move on.

How to Overcome Common Objections

Hearsay
Option 1: Business Records Exception (803(6)) — Call the custodian of records. Establish: (1) records kept in regular course of business, (2) entry made at or near time of event, (3) made by person with knowledge, (4) method of preparation indicates reliability.
Option 2: Excited Utterance (803(2)) — Show statement was made under stress of excitement caused by event, before deliberation possible.
Option 3: Medical Diagnosis (803(4)) — Statement by patient to healthcare provider describing medical history/condition, made for diagnosis/treatment.
Option 4: Present Sense Impression (803(1)) — Statement describing event or condition, made while declarant perceived it or immediately after.
Lack of Personal Knowledge
Lay Foundation: "Where were you when this happened?" "Did you see it?" "Did you hear it?" "Were you present?"
Establish Perception: "Can you see from where you were standing?" "How far away were you?" "Was it daylight?" "Anything blocking your view?"
Expert Not Qualified
Establish Qualifications Through: Education, training, certifications, licenses, years of experience, prior testimony, publications, peer recognition, specific knowledge of case-relevant discipline.
Daubert Factors (TRE 702): Testing, error rates, acceptance in field, reliability of methodology.
Example Foundational Qs: "Dr. Smith, how many knee injuries have you treated?" "What is your board certification?" "Have you testified as an expert before?"
Leading Question (on Direct)
Rephrase as Open-Ended: Instead of "You were hit from behind, correct?" ask "How were you hit?"
Use "W" Questions: Who, What, When, Where, Why, How — these avoid leading.
Avoid Yes/No Answers: "What did you observe?" not "You observed the light was red, didn't you?"
Compound Question
Break into Single Questions: "Did you talk to John that day?" (pause for answer) "What did you tell him?" (separate question)
One Thought per Question. Let witness answer each part fully before moving to next.
Assumes Facts Not in Evidence
Lay Foundation First: Establish the fact independently before asking follow-up questions that assume it.
Bad: "How fast was the defendant driving?" (assumes defendant was driving)
Good: "Were you driving or was someone else?" (establishes fact) Then: "How fast was the defendant driving?" (now it's proper)
